COLLECTION OF PERSONAL INFORMATION

On some of our Sites, we offer health assessment tools that ask you to provide self-assessment information. We may also ask you to provide additional information such as your e-mail address if you want to obtain additional services, information, participate in a contest or to resolve complaints or concerns.

 

Our web server may collect information related to your visit to our Sites, including: the IP address and domain used to access our Sites; the type and version of your browser; the website you came from to access our Sites; the page you entered and exited at; any website page that is viewed by that IP address; and what country you are from.

HOW DOES THE COMPANY USE INFORMATION GATHERED ABOUT ONLINE VISITORS? 

Before forwarding us any personal information, please be advised that any information gathered on our Sites may be used in the aggregate for research and development relating to our Sites and/or for future site development and, if you ask us to send you promotional materials. DISCLOSURE OF INFORMATION 

The personal information collected is used and disclosed for our business purposes. Your personal information may be shared with our employees, contractors, consultants, affiliates and other parties who require such information to assist us with establishing, maintaining and managing our relationship with you. In addition, personal information may be disclosed or transferred to another party in the event of a change in ownership of, or a grant of a security interest in, all or a part of the Company.

 

The Company may collect, use or disclose your personal information without your knowledge or consent where we are permitted or required by applicable law or regulatory requirements to do so.

 

Please note that any of these disclosures may involve the storage or processing of personal information outside of Canada and may therefore be subject to different privacy laws than those applicable in Canada, including laws that require the disclosure of personal information to governmental authorities under circumstances that are different than those that apply in Canada.

  

COOKIES 

The Company, in common with many web site operators, may use standard technology called "cookies" on its Sites. When you visit the Sites, we place a cookie on the hard drive of your computer to track your visit. A cookie is a small data file that is transferred to your hard drive through your web browser that can only be read by the website that placed the cookie on your hard drive. Change Without Pain Inc. ("The Company", together with its affiliates and subsidiaries, "we", "us", "our" and terms of similar meaning) provides this Website (this site and any software provided by the Company for use with the site, the "Site") to you subject to these terms of use (these "Terms"). In these terms we describe users ("Users") of the Site as both registered and unregistered users.

 

Please read these Terms carefully before using the Site. By accessing, using or browsing the Site you agree to be legally bound by these Terms and all terms, policies and guidelines incorporated by reference in these Terms. At present we do not charge any fees or other charges for the use of the Site. Content provided by Users is called "User Content". User Content is that User's property. The Company's only right to that User Content is the limited licenses to it granted in these Terms.

If any provision of these Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. If we choose not to enforce any right that we have against you at any time, then this does not prevent us from later deciding to exercise or enforce that right.

 

We shall have no liability to you for any breach of these Terms caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, pandemic, explosion or accident.

 

The Site is controlled by the Company and operated by it from its offices in Ontario, Canada. You and the Company both benefit from establishing a predictable legal environment in regard to the Site. Therefore, you and the Company explicitly agree that all disputes, claims or other matters arising from or relating to your use of the Site will be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

 

The Company may assign any or all of its rights hereunder to any party without your consent. You are not permitted to assign, sublicense or otherwise transfer any of your rights or obligations hereunder without the prior written consent of the Company, and any such attempted assignment will be void and unenforceable.

 

These Terms constitute the entire agreement between you and the Company regarding your use of the Site, and supersede all prior or contemporaneous communications whether electronic, oral or written between you and the Company regarding your use of the Site. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

 

If you register for an account on the Site, you agree to (a) provide accurate, current and complete information as may be prompted by any registration forms on the Site ("Registration Data"); (b) maintain the security of your password; (c) maintain and promptly update the Registration Data, and any other information you provide to the Site, and to keep it accurate, current and complete; and (d) accept all risks of unauthorized access to the Registration Data and any other information you provide to the Site.
